Welcome to ScanwiseAI. These Terms of Service ("Terms") govern your use of the ScanwiseAI mobile application and related services (collectively, the "Service") provided by ScanwiseAI ("we", "our", or "us").
By downloading, installing, or using our Service, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our Service.
To use certain features of the Service, you must create an account. When creating an account, you agree to:
You must be at least 16 years old to create an account and use our Service. By using the Service, you represent that you meet this age requirement.
Each user may only maintain one account. Creating multiple accounts to circumvent restrictions or limitations is prohibited and may result in termination of all accounts.
The Service offers both free and premium subscription plans. The free plan has limited features, while the premium plan provides full access to all features for a monthly fee.
You may cancel your subscription at any time through your app store account settings. Cancellation takes effect at the end of the current billing period. No refunds will be provided for partial months.
We reserve the right to change subscription prices. We will provide reasonable notice of any price changes and give you the opportunity to cancel before the new price takes effect.
To ensure fair use and prevent unauthorized sharing of accounts, premium subscriptions are limited to use on a maximum of three (3) devices per account.
You can view and manage your registered devices in the app's Account settings. If you reach the device limit, you must remove a device before adding a new one.
Sharing your account credentials with others is strictly prohibited. Violation of this policy may result in immediate termination of your account without refund.
You may use the Service only for lawful purposes and in accordance with these Terms. You agree to use the Service for personal, non-commercial purposes only unless you have obtained our prior written consent.

The Service, including its design, features, and content, is owned by ScanwiseAI and is protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, or create derivative works without our permission.
You retain ownership of all documents and content you create, scan, or upload using the Service. By using the Service, you grant us a limited license to process your content solely for the purpose of providing the Service.
If you provide us with feedback or suggestions about the Service, you grant us the right to use such feedback without compensation or attribution.
Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review our Privacy Policy to understand how we collect, use, and protect your information.
We strive to provide a reliable Service, but we do not guarantee that the Service will be available at all times. We may suspend or terminate the Service for maintenance, updates, or other reasons without prior notice.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
While we strive for high accuracy in our text recognition (OCR) features, we do not guarantee perfect accuracy. You are responsible for verifying the accuracy of extracted text.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, SCANWISEAI SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR USE, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.
OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SERVICE IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
You agree to indemnify and hold harmless ScanwiseAI, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the Service or violation of these Terms.
You may terminate your account at any time by using the account deletion feature in the app or by contacting us at support@scanwiseai.com.
We may suspend or terminate your account at any time for any reason, including if we reasonably believe you have violated these Terms. Upon termination, your right to use the Service will immediately cease.
Upon termination, all data associated with your account will be deleted in accordance with our Privacy Policy. Some provisions of these Terms will survive termination, including intellectual property rights, disclaimers, and limitations of liability.
These Terms are governed by the laws of the Netherlands, without regard to its conflict of law provisions.
Any disputes arising from these Terms or the Service shall be resolved exclusively in the courts of the Netherlands.
Before initiating any legal proceedings, you agree to contact us first at legal@scanwiseai.com to attempt to resolve the dispute informally.
We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms in the app or on our website and updating the "Last updated" date. Your continued use of the Service after such changes constitutes acceptance of the updated Terms.
These Terms, together with our Privacy Policy, constitute the entire agreement between you and ScanwiseAI regarding the Service.
If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
Our failure to enforce any right or provision of these Terms will not be considered a waiver of such right or provision.
You may not assign or transfer these Terms without our prior written consent. We may assign or transfer these Terms without restriction.
